Tunisian Decree No. 48 Transfers Encryption Oversight from ANCE to CERT, Introducing Key Changes to Type Approval Validity
On February 6, 2020, the Tunisian government enacted Decree No. 48, introducing significant changes in the regulation of encryption approvals. This move marks a significant step towards streamlining the certification process and enhancing the efficiency of regulatory oversight in Tunisia.
Governmental Decree No. 48 brings two major updates:
Unified Certification: CERT now regulates encryption approvals, a role previously handled by ANCE. A single certificate will now cover both RF/telecom and encryption requirements, simplifying the approval process.
Indefinite Validity: Type Approval Certificates issued by CERT will have indefinite validity, replacing the previous three-year renewal requirement. Existing certificates nearing expiration will need to be reissued under this new system if those devices are to be imported into Tunisia in the future.
